Coaching Terms and Agreement
This agreement is made between TLC Coaching and Consulting LLC (owner of the 10k 30 Day PUSH Program) and the student named and submitted on the online registration page.
Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential.
TLCCC agrees to maintain an ethical and professional working boundary that will foster trust, needed to build positive rapport to conduct a collaborative coaching relationship. The student is responsible for creating and implementing their own physical, mental and emotional well-being, decisions, choices, actions and results during the course of this coaching program. As such, the student agrees that TLCCC is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by TLCCC coaches and consultants. The Student understands that coaching is not to be used as a substitute for professional advice by legal, mental, medical or other qualified professionals and will seek independent professional guidance for such matters. If the student is currently under the care or support of a professional, legal or other identified professional, TLCCC coaches and consultants will recommend that the student to inform that provider for services outside the scope of practice for TLCCC coaches and consultants. The student agrees to communicate honestly, be open to feedback and assistance and create the time and energy to participate fully in the program.
TLCCC coaches and consultants and the student agree to engage in 10k 30 Day PUSH program by using internet, telephone and communication application software to conduct sessions and classes. TLCCC coaches and consultants will be available to the student by e-mail and voicemail in between scheduled meetings as defined by the TLCCC coaches and consultants. TLCCC coaches and consultants may also be available for additional time, outside of the programs alotted time schedule, per client’s request for purchase of additional services, products and services confirmed by the TLCCC coaches and consultants.
All students registering to join the 10k 30 Day PUSH program must pay in full before the receiving access to the program. Payments are collected and processed by paypal through website direct processing at TLCCC discretion. Refund & Rescheduling Policies will be enforced: Once you have paid and have enrolled in the program refunds are only permitted before the start date of the program. Refunds will not be granted for paid program enrollment once the program has commenced. All allowable refunds must be requested in writing and sent to the email address info@10k30daypush.com before the start of the program. We’ll do our best to accommodate our students requests. Any purchase or issuance of intellectual property, worksheets, homework assignments provided are NON-REFUNDABLE.•
Chargebacks: Any chargeback or payment dispute caused by the client to a bank or credit card company, will result in project suspension and in some cases, a complete cancellation in all work being left undone (or reversed) without notice. Furthermore, the amount of the chargeback fee will be issued to student (to recover any fees passed on to us by the credit card company or payment process company). In Addition, any outstanding balances accrued as a result of the chargeback(s) will have to be paid in full before we restore service, deliver any files, or commence any work. Please email info@10k30daypush.com immediately should any billing issues arise to prevent disruption in services. Requesting a chargeback or opening a dispute for a valid charge from us is fraud. Chargebacks are never a legal or appropriate means of obtaining a refund. All disputes will be challenged with legal representation with sufficient evidence from our records. We may, at any time, and at our sole discretion, modify these Terms and Conditions of Use, including our Policy, with or without notice to the User. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms.
Confidentiality: This coaching relationship, as well as all information (documented or verbal) that the student shares with TLCCC coaches and consultants as part of this relationship, is bound to confidentiality but is not considered a legally confidential relationship (like in Medicine or Law). TLCCC coaches and consultants agrees not to disclose any information pertaining to the student without the student's consent. TLCCC coaches and consultants will not disclose the student's name as a reference without the student's consent. Confidential information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the student; (b) is generally known to the public or in the student's industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the student; (d) is independently developed by the Coach without use of or reference to the student's confidential information; or (e) that the Coach is required by law to disclose.
Earnings disclaimer

The use of our information, products and services should be based on your own due diligence and you agree that 10K30DayPUSH and the advertisers/ sponsors of this website are not liable for any success or failure of your business that is directly or indirectly related to the purchase and use of our information, products and services reviewed or advertised on this website.
Limited Liability: Except as expressly provided in this agreement, TLCCC coaches and consultants makes no guarantees or warranties, express or implied. In no event will TLCCC coaches and consultants be liable to the student for consequential or special damages. Notwithstanding any damages that the student may incur, TLCCC coaches and consultants entire liability under this agreement, and the student's exclusive remedy, will be limited to the amount paid by the student to TLCCC coaches and consultants under this agreement for all services rendered up until the termination date. This is the entire agreement of the parties, and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written and oral representations. If a dispute arises out of this agreement that cannot be resolved by mutual consent, the student and TLCCC coaches and consultants agree to attempt to mediate in good faith for up to 90 days after notice given. The student release from liability and waive their right to sue TLC Coaching Consulting LLC. and their employees, officers, volunteers and agents from any and all claims, resulting in any physical injury, illness (including death) or economic loss that the Client may suffer because of their participation in this 10k 30 day PUSH program and services, including any travel to and from in person sessions or activities. Enrollment and payment into the 10k 30 Day PUSH program and services is consent that the student has read and agree to the agreement terms and its conditions.
